Welcome to Vaichii.com—the online atelier and shop for Frida, also known as Vai.chii. These Terms & Conditions explain the rules for using this site and purchasing commissions, digital downloads, and physical prints.

1. Acceptance of Terms

By accessing or using Vaichii.com, purchasing products or services, or interacting with VaiBot, you agree to these Terms. If you do not agree, please do not use the Site.

2. What I Offer

• Portfolio showcasing my artwork
• Commission services (custom artwork created for you)
• Digital downloads (wallpapers, brush packs, high-res artwork)
• Physical prints fulfilled by Printful
• VaiBot—an AI assistant to help with questions

3. Orders, Pricing & Payments

All prices are listed in USD. Payments are processed securely via Stripe. Taxes, VAT, customs duties, and import fees are the buyer's responsibility where applicable.

4. Commission Policies

4.1 Pricing

Final pricing may vary based on complexity, number of characters, and background detail. I'll always confirm the final price before starting work.

4.2 Turnaround Time

Typical turnaround is 2-4 weeks depending on my queue and the commission complexity. Rush orders may be available for an additional fee. Deadlines are not guaranteed unless explicitly agreed in writing.

4.3 Revisions

Each commission includes 2 minor revisions at the sketch stage. Major changes (different pose, character redesign, etc.) or revisions requested after sketch approval may require additional fees.

4.4 Cancellations & Refunds

• Before work begins: Full refund available
• Sketch stage: 50% refund (covers time spent)
• After sketch approval: No refund (work is in progress)
• Artist-initiated cancellation: Full refund provided

4.5 Artistic Style

When you commission me, you're commissioning my personal artistic style. Minor variations in style, color, and interpretation are part of the creative process. I'll do my best to bring your vision to life while maintaining my artistic voice.

5. Digital Downloads

Digital downloads are licensed, not sold. When you purchase a digital download, you receive a personal-use license.

What you CAN do:

• Use as personal wallpapers, references, or inspiration
• Print for personal, non-commercial use
• Share with credit (link back to vaichii.com)

What you CANNOT do:

• Redistribute, resell, or claim as your own
• Use commercially without written permission
• Use for AI training, datasets, or machine learning
• Mint as NFTs or use in blockchain projects

All digital download sales are final unless required by law.

6. Physical Prints

Physical products are printed and shipped by Printful, a third-party print-on-demand service.

• Damaged or defective items: Report within 30 days of delivery for replacement
• Lost packages: Report within 30 days of estimated delivery date
• Color variations: May occur due to differences between screens and print output
• Returns: Generally not accepted for buyer's remorse, but contact me if there's an issue

7. Intellectual Property

All artwork on this site remains my intellectual property unless otherwise agreed in writing.

• Buyers receive a personal-use license only
• I retain the right to display commissioned work in my portfolio
• Commercial use requires a separate license agreement

8. User Conduct

By using this site, you agree not to:

• Harass, abuse, or send inappropriate content
• Use artwork for unauthorized purposes (AI training, redistribution, etc.)
• Attempt to exploit, hack, or misuse any site features
• Initiate chargebacks without first contacting me

9. VaiBot Disclaimer

VaiBot is an AI-powered assistant designed to help answer questions about my art, commissions, and the site. Please note:

• VaiBot provides general guidance only
• Responses are not legally or financially binding
• VaiBot may occasionally provide incorrect information
• For official inquiries, please email me directly

10. Limitation of Liability

To the maximum extent permitted by law, my liability is limited to the amount you paid for the relevant product or service. I am not liable for indirect, incidental, or consequential damages.

11. Dispute Resolution

If you have a concern, please contact me at frida@vaichii.com first. I'll do my best to resolve issues fairly and promptly.

These Terms are governed by the laws of the United States. Any disputes will be resolved in accordance with applicable law.

12. Privacy

Please review our Privacy Policy for information about how we collect, use, and protect your data.

13. Changes to These Terms

I may update these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Continued use of the site after changes constitutes acceptance of the updated Terms.
